This is not a doom and gloom article. The majority of claims go through smoothly and the people from the insurance company are helpful throughout. Indeed, most small claims go well. To understand the potential problem, we need to look at the role of the claims adjuster. It’s not their job to represent your interests in dealing with the insurer. Indeed some have contracts of employment giving them monthly closing targets, i.e. they are rewarded if they persuade you to accept less than the insurer has penciled in as the likely amount owing. Such adjusters will try to persuade or bully you into accepting less than you are entitled to receive. So how should you deal with adjusters?

First assume the meeting will go badly. There’s absolutely no point in arranging to meet if you are unprepared. If you get angry and annoyed, this will simply turn you into a “difficult person” in the insurer’s records and the claim will go even more slowly. You need to have all your evidence organized. More importantly, you need to be sure you can stay calm. If there’s the slightest doubt in your mind, get someone to help. A friend can warn you if you are obviously about to lose your temper. Better still, it may be better to employ an independent adjuster to deal with the insurer for you. For the most part, friends do not charge. Independent adjusters either charge a fee for their services or take a percentage of the amount they recover from the insurer.

When you go into the meeting, present your evidence and supply copies of all the relevant documents, e.g. of the doctor’s treatment plans for your injuries, your pay checks to show loss of earnings, the repair estimates, market research into the value of your vehicle, and so on. Never agree to anything under pressure. If little progress is being made, schedule a new meeting saying you will continue the discussion after speaking with your state’s Insurance Commissioner or your attorney or both. You need to demonstrate you know your rights and will not be afraid to continue until you receive a fair settlement. The fact you bought cheap car insurance does not prevent you from getting good value in a settlement so long as you listen carefully to what the adjuster says and counter his or her arguments. Remember you usually get the best results in an amicable settlement. If negotiations fail, you want to show it’s the insurer’s fault.
