Auto insurance quotes: what to do if your claim is rejected

We first need to consider why your claim has been turned down. Needless to say, insurers tend not to be very impressed if they discover you have made a dishonest claim. This includes exaggerating the amount you have lost. They also turn you down if you claim without the cover. Suppose someone steals your beautiful truck so you claim but are told you only have liability and collision cover. Sadly, without having paid for comprehensive, you cannot claim. Did you remember to tell the insurer when you customized your ordinary truck and made it beautiful? If so, the insurer can turn you down or only pay you the amount you could have claimed before you customized. Some people forget to pay on time and then discover they cannot claim because the policy has lapsed. Then there are all those annoying terms which limit or exclude liability if you were driving while under the influence of alcohol or some disabling substance. OK so none of that applies to you!

Insurers make money by refusing to pay you. This may not sound very reasonable. After all, if they refuse too many people, their brand image will not look so good. Except insurers routinely refuse to pay people some or all of what they claim and it’s not headline news. So what excuses do they give? Usually, they point to something you “forgot” to tell them, or the amount you are claiming exceeds the limit, and so on. If there’s any doubt at all what the reason is, you must push the insurer to put the grounds of their decision in writing. Now comes the interesting part.

If you are sure, absolutely sure, you have a valid claim, you can complain to your state’s Insurance Commissioner. Every state in the union has a Commissioner and it’s his or her job to investigate all allegations of bad practice by one of the insurance companies licensed by that state. If the Commissioner agrees with you, he or she can order the insurer to pay you. Some policies have a mediation or arbitration provision written into the policy. This can be a cheap way of resolving the dispute if you do it on your own. If you prefer to use an attorney, you may well be advised not to bother but to sue the other at-fault party or to file a bad faith claim against the insurer.

Cheap car insurance companies have a poor reputation and are often accused of refusing to pay out on claims. But if you hit problems, it’s not necessarily wise to get auto insurance quotes to switch to another company. Any new company will know you have made a claim and it has run into problems. They may not be too happy to see you run to them. This does not mean you cannot find inexpensive car insurance with another company. But it may be better to resolve the dispute before you try moving.
